POSTIVA is an AI-powered platform designed to support social media creators, freelancers, and personal brands by:

• Assisting with content creation and planning
• Providing insights and analytics
• Supporting moderation and automation features
• Integrating with third-party platforms such as Facebook and Instagram

The Service may evolve over time, and features may be added, modified, or removed.

3. Eligibility

• You must be at least 18 years old to use the Service.
• By using POSTIVA, you confirm that you have the legal capacity to enter into these Terms.

4. User Accounts

To access certain features, you may be required to create an account.

You are responsible for:

• Providing accurate information
• Maintaining the confidentiality of your login credentials
• All activities performed under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Facebook & Instagram Integrations

If you connect your Facebook or Instagram account:

• You grant us permission to access data according to the permissions you approve
• Data is used only to provide the functionality of the Service
• You may revoke access at any time via Meta account settings

Use of Meta services is also governed by Facebook's and Instagram's own terms and policies.

6. Acceptable Use

You agree not to:

• Use the Service for unlawful purposes
• Violate applicable laws or third-party rights
• Abuse, overload, or interfere with the Service
• Attempt to gain unauthorized access to systems or data
• Use the Service to distribute harmful, misleading, or illegal content

7. AI-Generated Content Disclaimer

POSTIVA may generate content using artificial intelligence.

• AI-generated content is provided for assistance only
• We do not guarantee accuracy, legality, or suitability
• You are solely responsible for reviewing and using generated content before publishing

8. Payments & Subscriptions

POSTIVA offers a FREE plan and paid CREATOR and PRO subscriptions, billed monthly in PLN. Prices shown on postiva.ai are exclusive of VAT.

• The FREE plan does not expire and does not require a payment card.
• CREATOR and PRO include a 30-day free trial when the subscription is activated on the web version. A payment card is required to start the trial. If you do not cancel before the trial ends, the subscription renews automatically at the then-current monthly price (PLN 124.99 for CREATOR, PLN 244.99 for PRO).
• The free trial is available only when the subscription is activated on the web version. Subscriptions purchased through the iOS or Android app do not include a free trial and are billed, renewed, and cancelled through the respective app store's payment system.
• You can cancel a subscription at any time before the end of the current billing period. Cancelling stops the next renewal; access continues until the end of the period already paid for (or, during a trial, until the end of the trial).
• Fees already charged are non-refundable except where required by applicable law.

10. Suspension & Termination

We may suspend or terminate access to the Service if:

• The Service is misused

Users may stop using the Service and request account deletion at any time.

All content, software, and branding related to POSTIVA remain the intellectual property of Webstudio - Tomasz Furca, unless otherwise stated.

You may not copy, modify, or distribute any part of the Service without permission.

12. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available"
• We are not liable for indirect, incidental, or consequential damages
• We do not guarantee uninterrupted or error-free operation

13. Governing Law

• These Terms are governed by the laws of Poland.
• Any disputes shall be resolved by the competent courts in Poland.
