These Terms of Service ("Terms") govern access to and use of the POSTIVA platform available at https://postiva.ai (the "Service"), operated by Webstudio - Tomasz Furca ("we", "our", or "us").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of the Service

POSTIVA is an AI-powered platform made for small businesses, freelancers, and creators. It supports them by:

• Assisting with content creation and planning
• Providing insights and analytics
• Supporting moderation and automation features
• Integrating with third-party platforms such as Facebook and Instagram

The Service may evolve over time, and features may be added, modified, or removed.

3. Eligibility

• You must be at least 18 years old to use the Service.
• By using POSTIVA, you confirm that you have the legal capacity to enter into these Terms.

4. User Accounts

To access certain features, you may be required to create an account.

You are responsible for:

• Providing accurate information
• Maintaining the confidentiality of your login credentials
• All activities performed under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Facebook & Instagram Integrations

If you connect your Facebook or Instagram account:

• You grant us permission to access data according to the permissions you approve
• Data is used only to provide the functionality of the Service
• You may revoke access at any time via Meta account settings

Use of Meta services is also governed by Facebook's and Instagram's own terms and policies.

6. Acceptable Use

You agree not to:

• Use the Service for unlawful purposes
• Violate applicable laws or third-party rights
• Abuse, overload, or interfere with the Service
• Attempt to gain unauthorized access to systems or data
• Use the Service to distribute harmful, misleading, or illegal content

We reserve the right to take action if misuse is detected.

7. AI-Generated Content Disclaimer

POSTIVA may generate content using artificial intelligence.

• AI-generated content is provided for assistance only
• We do not guarantee accuracy, legality, or suitability
• You are solely responsible for reviewing and using generated content before publishing

8. Payments & Subscriptions

POSTIVA offers a FREE plan and paid CREATOR and PRO subscriptions, billed monthly. The currency depends on the version of the site you subscribe on:

• On the English site (postiva.ai) and its checkout, prices are in US dollars: USD 0 for FREE, USD 29.99 for CREATOR and USD 49.99 for PRO.
• On the Polish site (postiva.ai/pl/) and its checkout, prices are in Polish złoty: PLN 0 for FREE, PLN 124.99 for CREATOR and PLN 244.99 for PRO.

Prices shown on postiva.ai are exclusive of VAT.

• The FREE plan does not expire and does not require a payment card.
• CREATOR and PRO include a 30-day free trial when the subscription is activated on the web version. A payment card is required to start the trial. If you do not cancel before the trial ends, the subscription renews automatically at the then-current monthly price in the currency of the site you subscribed on (USD 29.99 for CREATOR and USD 49.99 for PRO on the English site; PLN 124.99 for CREATOR and PLN 244.99 for PRO on the Polish site).
• The free trial is available only when the subscription is activated on the web version. Subscriptions purchased through the iOS or Android app do not include a free trial and are billed, renewed, and cancelled through the respective app store's payment system.
• You can cancel a subscription at any time before the end of the current billing period. Cancelling stops the next renewal; access continues until the end of the period already paid for (or, during a trial, until the end of the trial).
• Fees already charged are non-refundable except where required by applicable law.

Personal data is processed in accordance with our Privacy Policy, available at:

• Data collection and usage
• Facebook & Instagram data handling
• Data retention and deletion
• GDPR user rights

10. Suspension & Termination

We may suspend or terminate access to the Service if:

• These Terms are violated
• The Service is misused
• Required by law or platform policies (e.g. Meta)

Users may stop using the Service and request account deletion at any time.

11. Intellectual Property

All content, software, and branding related to POSTIVA remain the intellectual property of Webstudio - Tomasz Furca, unless otherwise stated.

You may not copy, modify, or distribute any part of the Service without permission.

12. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available"
• We are not liable for indirect, incidental, or consequential damages
• We do not guarantee uninterrupted or error-free operation

13. Governing Law

• These Terms are governed by the laws of Poland.
• Any disputes shall be resolved by the competent courts in Poland.

14. Changes to These Terms

We may update these Terms from time to time.
Changes will be published on this page with an updated "Last updated" date.

Continued use of the Service constitutes acceptance of the updated Terms.

15. Referral Program

The referral program (Invite & Earn in the app) lets you share a personal referral link and earn a commission when people you refer pay for a subscription. A person counts as your referral when they create a new POSTIVA account through your link and the code is applied within 24 hours of their new account being created.

• Commission. You earn 20% of the USD list price of each CREATOR or PRO payment (the first payment and every renewal) made by a user you referred, for as long as they stay on a paid plan. Commission is calculated and shown in USD.
• Minimum payout. You can request a payout once your balance of pending commissions reaches 100 USD.
• How to request a payout. Email [email protected] from the email address of your POSTIVA account, with your bank details. There is no payout request in the app.
• Payout method and currency. Payouts are made by bank transfer in USD or EUR, as you choose. A EUR payout is converted from your USD balance at the European Central Bank reference rate on the day the transfer is made. We cover the bank fees.
• Timing. We pay within 30 days of your payout request.
• Invoices and taxes. If you refer as a business, you issue an invoice for the payout to Webstudio - Tomasz Furca, NIP 7822422854. If you refer as an individual, you provide the details we need to make the payment. Each referrer is responsible for their own taxes.
• Misuse. Commissions that come from fraud, self-referral or other abuse of the program are cancelled. We reserve the right to take action if misuse is detected.
• Changes and termination. We may end or change the referral program with 30 days' notice published on this page. When the program ends or your account ends, a pending balance of at least 100 USD is paid out; a smaller balance lapses.
